(b) An officer who fails to take up the post to which he is

appointed, or leaves or gives notice of his intention to resign from the service before completion of his full tour of service, will be required to refund to the Hong Kong Government:-

(1) the outstanding balance of any recoverable advances

of salary which he may have received;

(2) the cost to the Hong Kong Government of any school

passages (see Section II above) provided for his children during that tour.

An officer on first appointment will be required to sign an Agreement to this effect with the Crown Agents for Overseas Governments and Administrations in London or, in other countries, with the authority who acts on behalf of the Hong Kong Government.

(ii) Officers on re-appointment

(a) An officer who fails to take up the post to which he is

re-appointed, or leaves or gives notice of his intention to resign from the service before completing half of the second or subsequent normal tour, will be required to refund to the Hong Kong Government that proportion of the cost to Government of outward passages to Hong Kong provided in that tour for himself and his family (if any) which the uncompleted portion of the half tour bears to the half tour.

(b) An officer who fails to take up the post to which he is

re-appointed, or leaves or gives notice of his intention to resign from the service before completion of his full tour of service, will be required to refund to the Hong Kong Government:-

(1) the outstanding balance of any recoverable advances

of salary which he may have received;

(2) the cost to the Hong Kong Government of any school

passages (see Section II above) provided for his children during that tour.

(iii) An officer may terminate his service during the course of a tour by giving a

a minimum of three calender months' notice of his intention to resign or by paying to Government one month's salary (including any other allowances where applicable) in lieu of notice. He will be eligible for homeward passages to his country of origin for himself and his wife only if his resignation will not take effect until he has:-

(a) served the requisite period of notice; and

(b) completed the full tour of service applicable in his case

provided that he claims and avails himself of such passages within one month from the date he ceases duty.

(iv) (a) An officer who resigns before completing his first tour forfeits his

vacation leave. An officer on his second or subsequent tour who resigns after serving the requisite period of notice will normally be granted any vacation leave earned since last returning from vacation leave.
