Corruption: Investigation of Allegations

This Circular describes the procedure to be followed when allegations of corruption against Government servants are received.

(A) Allegations involving the department which receives the communication
All such communications must be treated in the strictest confidence. They must be seen by an officer of at least Assistant Director status, and preferably by the Head of Department himself.

The Head of Department or the officer who has been delegated to deal with allegations of corruption must without delay send the original communication (if written) or a full report of the allegation (if oral) to the Director of Operations of the Independent Commission Against Corruption at Sincere Building, 5th floor, 173 Des Voeux Road, Central, Hong Kong. A memorandum containing sufficient background information to enable the Commission to understand and investigate the allegation must be sent at the same time. The Head of Department should, in addition, if possible state whether :
(a)
(b)
any of the statements in the communication are known to. be true or false;
the officer accused is believed to be of good repute; (c) other similar allegations have been made previously. Heads of Departments are to avoid making enquiries or taking action which may prejudice subsequent action by the Independent Commission Against Corruption.
(B) Allegations involving departments other than the one receiving the
communication

Any allegation which concerns another department must be forwarded to the Director of Operations of the Independent Commission Against Corruption. The allegation must not be referred to other parties who may be concerned. This will be done if necessary by the Commission. Where the allegation concerns the Independent Commission Against Corruption it must be forwarded to the Attorney General.
