original group of intruders left the room and were concentrating
their attention on the room in which the two guests were. The
witness then saw another group of men coming into the apartment
house and shouted to his fellow employee to run away. They
ran into the bathroom, climbed through the window and down a
ladder connected with a neon sign-board just outside the window.
They were able to climb down one floor only, and eventually
re-entered the building through a flat on that floor.

Both the employees said that, while they were on
the sign-board, they saw a "black shadow" falling past them
down into the street. That was the deceased.

The case for the Crown was that the deceased was so
terrified by the attack on him, and by what he saw of the
attacks on others when he looked out of the bathroom, that he
tried to escape:
In order to do so, he also climbed out of the'
bathroom window, and subsequently fell to the ground. He died
some three hours later from the injuries he sustained when
he fell.
