The pathologist told the jury that the parallel linear

bruises were consistent with having been caused by a rod-like or

whip-like object. In answer to a question from me he said the

injuries other than those on the head were consistent with

having been caused by billiards' cucs. Those to the back of

the head, in his opinion were consistent with a "somewhat longish"

blunt instrument being used. If it were a billiard cue inflicted

the head injurios he thought it would have required the thicker

end to do so.

Evidence was produced that some of the group used

billiard cues and were soon to leave them on a table as they left.

Four cues were found on the table, three of which were of the

conventional wooden type; the fourth was made of aluminium and

was markedly bent.

The accused's defonce was an alibi. He said that he was

in bed and asleep at the time the deceased mot his death ́and his

mother and his sister gave evidence to support that.

The jury were absent from 1.10 p.m. until 3.50 p.m.

and then returned their verdict of guilty,

There was a lot of background material available to the

prosecution in this case that could havo established a motive for

the assault on the deceased but as its origin was hearsay it was not admissible. However, I think it might be of sone help to Your Excellency.

A friend and erstwhile co-worker of the deceased govona

statement to the police. He said that in August, 1972 the deceased told him that he was being badgered by another co-worker for $300 he owed him. He said that: ho ceased working with the deceased but
