ANNEX C TO XCR(74)61
NOTE BY THE ATTORNEY GENERAL
CHARGE AND CONVICTION,
TSE Yung-tim (who was 20 years of age at the time of
the offence) and LAM Kwok-wah (who was 18 years of age at that
time) were charged with the murder of WONG Fat-nip. They were
convicted on 13th September 1973 and their appeals to the Full
Court were dismissed on 28th November 1973.
2.
BACKGROUND.
The murder arose out of a dispute over the repayment
of money loaned to a call-girl by a call-girl organisation for
which she worked for a short time. The girl lived with a man
by the name of HO So-kuen, who lived on her earnings as a
call-girl. She transferred from one such organisation to
another (of which the deceased was one of the operators) and
the money ($3,500) was advanced to her by the new organisation.
Her association with the new organisation was short-lived,"
and she left owing the money which had been lent to her (and
which she had given to HO So-kuen). Shortly before the offence,
she was seized by the new organisation and detained. Nego-
tiations between HO and the leader of the new organisation'
about repayment of the money failed and the girl was not
}
released. There was some evidence that HO and his associates
had to discontinue negotiations at one stage when they were
warned that an armed gang belonging to the new organisation
was in the restaurant where the discussions were taking place.
3.
The killing was probably a mixture of revenge and
an effort to recover the detained girl.
