In particular, there were comminuted fractures on the right top of the skull and a depressed fracture on the right side.

DEFENCE.
CHAN gave evidence at his trial. He described the history of his marriage and complained about his wife's conduct in a number of respects. Among other things, he alleged that she had been having an affair with another man while he was away at sea. He said that there had been quarrels between them, resulting in struggles, and that on a previous occasion his wife had grabbed his testicles during a quarrel.

He said that on the day in question he had been worshipping the gods outside his home and that on returning indoors his wife told him to remove his belongings and his ancestral tablets and censer. He told her that he would take them away when next he returned from sea, whereupon, he said, his wife became angry, picked up the tablets and censer and was going to throw them into the street. He recovered them from her and put them back in their place. This made him angry and he scolded his wife. His wife then rushed at him and attempted to grab his testicles, but missed and pinched his thigh instead. This pained him considerably and he pushed his wife to the floor. He said that his wife then got up and picked up a stool in order to hit him. He snatched it from her, whereupon she grabbed his testicles and squeezed violently. The pain which he suffered caused him to "lose his reason" and he "probably" struck his wife with the stool. He could not remember how many times he struck her. When asked to say whether the stool which he used was like the one in evidence, he gave a different version of the latter part of the struggle. He repeated that his wife grabbed and squeezed his testicles and said that she refused to let go. He had no choice but to push her away, and as a result she lost her balance and fell to the floor. He then noticed that her head was bleeding, became frightened and ran to call the Police.

CHAN's defence that his wife had caused him great pain by squeezing his testicles was inconsistent with his statement to the Police and was not mentioned by him in answer to the charge. The medical evidence was that there was no sign of bruising there on examination shortly after the events.
