MEMORANDUM FOR EXECUTIVE COUNCIL

DEATH SENTENCE PASSED ON CHAN CHEONG-HING

On 1st November 1973 CHAN Cheong-hing was convicted of the murder of CHEUNG Shui-fa and was sentenced to death. The report by the Honourable Mr Justice M. Morley-John, the trial transcript and the summing-up are being circulated to Honourable Members separately. A copy of the judge's report is attached at

An application by Chan for leave to appeal to the Full Court against conviction was dismissed on 27th December 1973. A copy of the judgment of the Full Court is at Annex B and a note by the Attorney General is at Annex C. e

A petition for clemency submitted by the prisoner through

the Director of Legal Aid is at Annex D.

Also annexed are a report by the Director of Home Affairs E & F (Annex E), a report by a probation officer (Annex F) and a police

antecedent statement (Annex G).

Honourable Members will be asked to advise whether the law should take its course or whether the sentence passed on CHAN Cheong-hing should be commuted. (If His Excellency decides that the sentence should be commuted, Honourable Members will be asked to advise on the sentence of imprisonment which should be substituted for the death sentence).
