NOTE BY THE ACTING ATTORNEY GENERAL.

CHARGE AND CONVICTION,

Five people

(a) CHAU Cheuk-yin (23 years of age at the time of the

offence though in evidence he said he was 20);

(b) LAI Fai (29 years of age at that time);

(c) HO Man-wai (under 18 at that time);

(a) WAN Mui-mui (a woman of about 34 at that time); and

(e) LIU Sim-shun (23 years of age at that time),

were charged with the murder on 25th May 1972 of CHAN Kwok-cheong. They were convicted on 3rd May 1973. Their appeals to the

Full Court were dismissed on 2nd October 1973. All five were also convicted of inflicting grievous bodily harm on YEUNG Lin- shing. HO was ordered to be detained during Her Majesty's pleasure because of his age.

BACKGROUND

WAN Mui-mui (with her husband) ran a call-girl organi- sation. CHAU, LAI, HO and LIU were associated with the running

of that business in one way or another.

3. Three people the deceased CHAN Kwok-cheong, YEUNG Lin-shing and PANG Po-chu (a girl of 16 years of age)

devised

a scheme to defraud WAN's organisation of $2,000 by offering her (PANG) to WAN as a prostitute. The idea was that, once the money had been obtained as an advance payment in respect of PANG's services, she would abscond. The approach to WAN's organisation was made through a man by the name of HAK Chai (a "professional" introducer of girls) who was known to WAN. The scheme was successful in that $1,000 was obtained, whereupon PANG disappeared without ever really joining the organisation. The three conspirators had persisted for a time in their efforts to obtain the full $2,000 but were refused and eventually settled

for the $1,000.

FACTS

Ön discovering that PANG had absconded, WAN sent CHAU and LIU to get YEUNG with a view to recovering the girl. They were accompanied by the introducer HAK Chai. The three picked up YEUNG at his place of employment and took him to the premises

in Kowloon at which YEUNG and the deceased had first contacted
