DEATH SENTENCES PASSED ON CHAU CHEUK-YIN, LAI FAI,

WAN MUI-MUI AND LIU SIM-SHUN

On 3rd May 1973 CHAU Cheuk-yin, LAI Fai, WAN Mui-mui, LIU Sim-shun and HO Man-wai were convicted of the murder of CHAN Kwok-cheong. Chau, Lai, Wan and Liu were sentenced to death and Ho, who was under 18 at the time of the offence, was sentenced to be detained until Her Majesty's pleasure be known. The report to the Governor by Mr Commissioner E. G. Baber, the trial transcript, and the judge's summing-up are being circulated. Honourable Members may wish to study again the trial judge's report at Annex A.

Appeals by the five convicted persons against conviction were considered by the Full Court on 2nd October 1973 and all were dismissed. A copy of the appeal judgment is at Annex B.

Petitions for clemency submitted by Chau, Lai, Wan and Liu are at Annex C and a note by the Attorney General is at Annex D.

Also annexed are a report by the Director of Home Affairs, reports by probation officers, and police antecedent statements E, FG (Annexes E, F and G respectively).

Honourable Members will be asked to advise whether the law should take its course or whether the sentences passed on CHAU Cheuk-yin, LAI Fai, WAN Mui-mui and LIU Sim-shun should be commuted. (If His Excellency decides that the sentences should be commuted, Honourable Members will be asked to advise on the sentences of imprisonment which should be substituted for the death sentences).
