I have the honour to report, pursuant to Clause XXXIV of the Royal Instructions, that on 31st August 1973, the above-named prisoner was convicted by a jury of six men and one woman of the murder of Pak Kwong-woon. The prisoner was accordingly sentenced to death. The prisoner appealed against his conviction. The Full Court dismissed his appeal on the 5th day of November, 1973.

The prisoner pleaded guilty to one count of robbery. not disputed that on 22nd March, 1973 the prisoner robbed a woman Shum Wai-fong of $50 in a lift at knife point inside Tung Fat Building, Nos. 200-206 Fa Yuen Street, Kowloon. I have recorded a conviction for the robbery but have not passed any sentence thereon.

It was alleged by the Crown that when Shum Wai-fong came out of the lift on the ground floor she pointed out the robber to the watchman Pak Kwong-woon, who then gave chase in an attempt to apprehend the prisoner.

In the course of the pursuit, two youths Cheung Yin-kwai and Wong Kwok-leung who were loading goods onto their company's lorry in Bute Street joined in the chase. The prisoner ran into a side lane in Bute Street and then through a bakery into Fa Yuen Street when he ascended the staircase of an adjoining building. At about this time the two youths lost contact with the watchman and they also lost sight of the prisoner. They could not locate the prisoner on the first floor of the building and so they went up to the second floor in search of him. Then they heard a commotion down below whereupon they descended to the first floor where they encountered the prisoner standing outside a flat holding a knife-like object in his hands. On being told to drop the weapon the prisoner said, "Either you die or I die" and in a threatening manner chased after the two youths with the weapon in his hand. At this
