DEATH SENTENCE PASSED ON CHAN HON-TONG

On 26th February 1973 CHAN Hon-tong was convicted
of the murder of WONG Yuk-lin and was sentenced to death. An appeal by Chan against conviction was dismissed by the Full Court on 26th April 1973. His subsequent application for leave to appeal to the Privy Council was dismissed on 31st October 1973.

The following papers concerning this case have already
been distributed to Honourable Members:
(a) the trial judge's report (the Honourable the Chief Justice
Sir Ivo Rigby);
(b) the judgment of the Full Court;
(c) a note by the Attorney General;
(d) a petition for clemency submitted on Chan's
behalf by his solicitors;
(e)
a report by the Director of Home Affairs;
(f) a report by the Probation Officer;
(g) the Police antecedent statement;
(h) a report by the Psychiatrist in charge, Siu Lam
Psychiatric Centre dated 11, 12, 73;
(i)
a report by the Psychiatrist in charge, Siu Lam Psychiatric Centre dated 8.2.73.

Honourable Members will be asked to advise whether the law should take its course or whether the sentence passed on CHAN Hon-tong should be commuted. (If His Excellency decides that the sentence should be commuted, Honourable Members will be asked to advise on the sentence of imprisonment which should be substituted for the death sentence).
