It is clear that section 68 of the Education Ordinance can be used

to check or contain the employment as teachers, whether in communist

or neutral schools, of persons who have received a significant part of

their education in China. In my opinion, the use of section 68 of the

Education Ordinance for this purpose can be effective only if applied

uniformly to schools of all categories, that is, communist or neutral,

and irrespective of whether or not they are in receipt of financial aid

It is from this point of view that the case now under

consideration may, I think, legitimately be regarded as crucial.

It will be relevant for me to draw attention here to another recent

in which I have issued a notice under the terms of paragraph (c) of

subsection (1) of section 68, of the Education Ordinance, and in which the

refusal referred to an application from the communist-controlled Pui Kiu

Evening School. This notice was issued on 12th February 1974, and

refused a permit in respect of the employment of Mr. TANG Jun to teach

mathematics at the said school. Representatives of the Pui Kiu Evening

School have called at the Education Department on three occasions,

March 1974, 11th March 1974 and 2nd April 1974, to protest at this refusal.

I must here draw attention to the increasing frequency of the

cases calling for consideration under section 68 of the Education Ordinance.

The number of notices of refusal issued under this section since 1st

January 1972, has been as follows:
