10. LEAVE OF ABSENCE AND LENGTH OF TOUR
I.: Vacation Leave

The officer will be on what are known as the leave terms". If the officer completes his tour of service, or if his services are terminated by the Government (see Section 16) for reasons other than misconduct, he may be granted, at the discretion of the Government, vacation leave as follows :-
Officers under the age of 40 (unless over the age of 35 and with an
aggregate of 10 years Colonial Service)
Length of tour:
21⁄2 years
Leave earning rate: 42 days a year or
thereof.

Officers who have attained the age of 40 regardless of length of service, or are over the age of 35 with an
aggregate of 10 years' Colonial Service
2 years
59 days year or proportionate part thereof.
(Notes: (1) An officer reaching the age of 40 (or 35
as the case may be) in the course of a tour will be granted leave at the higher rate with effect from his relevant birthday.
(2) "Length of tour" is the period which the
officer must normally serve before being eligible
to take vacation leave, calculated from the date of assumption of duty in Hong Kong on first appointment, or from the date of return from last leave.
(3) No travelling time is allowed, except for the
period of the direct unbroken air journey on first appointment, i.e. vacation leave commences on the date of the officer's departure from Hong Kong and he must return to duty not later than the day following the date on which his leave expires (but see Part II of this Section below re-advance of casual leave on first appointment and retention of leave for officers on subsequent tours).
