THE EMPLOYMENT (AMENDMENT)(NO. 2)

ORDINANCE 1974

(No. 51 of 1974)

This Ordinance is designed to give effect to some of the provisions of International Labour Convention No. 98.

2. The New section 21B confers certain rights on employees, whether or not they are employed by way of manual labour and irrespective of the amount of their wages, and protects them from action by employers and others which is intended to prevent the employees from exercising those rights.

The rights are

(a)

the right to become a member or an officer of a registered trade union;

(b) the right to take part at any appropriate time in

its activities; and

(c) the right to associate with other persons for the purpose of forming and registering a trade union.

The new section 21C makes it an offence to include in an offer of employment to a person a condition or requirement that he will relinguish his membership of a trade union, not become a member of a trade union or not associate with persons for the purpose of forming or applying for the registration of a trade union.

5. Before His Excellency the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, I advised that he could properly do so.
