An Ordinance to amend the Labour Tribunal Ordinance.

Enacted by the Governor of Hong Kong, with the advice and

consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Labour Tribunal Short title. (Amendment) Ordinance 1974.

2. Section 31 of the principal Ordinance is amended in sub- Amendment section (1) by deleting "a notice of appeal and does not agree to withdraw the appeal" and substituting the following-

"an application for leave to appeal and does not agree to withdraw the application".

3. Section 32 of the principal Ordinance is repealed and Repeal and replaced by the following-

"Leave to appeal on point of

law.

32. (1) If any party is dissatisfied with an award, order or determination by the tribunal on the grounds that the award, order or determination is-

(a) erroneous in point of law; or

(b) outside the jurisdiction of the tribunal, such party may, within seven days after the date of the award, order or determination, apply to the District Court for leave to appeal and the District Court may grant such leave.

(2) An application for leave to appeal under this section shall be-

(a) in the prescribed form which shall set out the grounds of appeal and the reasons in support of such grounds; and

replacement of section 32.
