(i) that we should remind Hong Kong that, before returns

are resumed, they should obtain assurances from the

South Vietnamese Government, similar to those obtained in the case of the 118; and

(ii) that Hong Kong should also be asked to obtain similar prior assurances from the Khmer Government before any further returns are made to the Khmer Republic..

It would be more satisfactory to obtain blanket assurances for all future cases, which would make it unnecessary to consult the Vietnamese or Khmer Government on each individual case. Recommendations

11. I recommend that we should tell Ilong Kong that we agree with the broad guidelines set out in the Political Adviser's letter, and I suggest that I should reply along the lines of the attached draft.

12. In para. 10 of his letter, the Political Adviser refers to the four Vietnamese, subsequently found to be illegal immigrants, who were arrested in the demonstration on 16/17 June, when the 118 were returned. We asked in our telegram no. 716 of 14 August that these should not be returned before there had been an opportunity for any interested organisation to try to arrange for them to go to a third country. Presumably Amnesty have done nothing about this, though the cases will have been known to them. It is clear that Hong Kong have done nothing. The arguments set out above apply; and, now that we are satisfied about the trials of the 118, I recommend that Hong Kong should be authorised to return these four to Vietnam as soon as they have obtained satisfactory further assurances from the Vietnamese authorities.

13. There are also the two outstanding cases of Khou San and Ly Han cited in the Political Adviser's para. 5, and in the annex to my submission of 7 June.. We must inform the Governor whether he can return Khou San to the Khmer Republic and not to Macao. In view of the comments now received from Phnom Penh I recommend that we should agree that Khou San and the other Khmers whose cases are pending should be so returned, after assurances have been obtained from the Khmer Government.
