has acquired for the MTR under the Ordinance at (a), The Corporation will be given the power to bore tunnels, without compensation except where physical damage to property is caused thereby. The Corporation may delegate its powers to agents or contractors working on its behalf. The Ordinance will provide for compensation for land owners, owners of buildings and statutory undertakers whose land, buildings or installations are affected by the construction of the MTR.

(a)

Honourable Members will be asked

to advise whether, subject where appropriate to the provision of the necessary funds by the Finance Committee of the Legislative Council:

the decision in principle to proceed with the construction of the full Mass Transit Railway as proposed by the Consultants should be publicly confirmed;

a firm decision should now be taken to proceed as soon as possible with the construction of the first four stages; further consultations should now be. entered into with the consortia listed in paragraph 14(b) above; the Consulting Engineers should continue to be employed, with broadly their present terms of reference, on a month- to-month basis, pending a final decision on the contractual arrangements to be adopted for constructing and equipping the Mass Transit Railway;

i

the additional work outlined in paragraph 33 above should be undertaken; arrangements should proceed for the setting up of a Mass Transit Railway Corporation along the lines set out in paragraphs 28-30 above; and

(vii) draft legislation should be prepared as
