Cannot agree to Revoke Colonial Regulations 61 and 62.

The Governor himself' agreed that he could not tinker

with these two Regulations w.thout incurring a good

deal of criticism.

In order therefore to satisfy the Governor's requirement

of meeting Blair-herr's points where possible, the

possible alternatives are:

(i) agree to revoke Col. Reg. 59 and amend the

Pensions Ordinance.

This would leave compulsory retirement entirely at thepower of the Governor under the Pensions Ordinance; the loss of the 'public interest' provisions; and no

(ii) agree to amendment of Pensions Ordinance if

Hong Kong can gain acceptance to this from the Staff Associations. There are likely to be very strong

bjections. There is also the question of

reciprocal right to leave whenever officers wish - something Hong Kong has objected to in the past. But, if Hong Kong can wear it, we might accept this, which would give Blair-Kerr something he wants.

At the same time, we should suggest keeping Col. Reg. 59. It would not prevent usage of Pensions Ordinance, would provide the Governor with another procedure; and would leave a Regulation governing

retirement in the Colonial Regulations.
