an investigation of an offence alleged or suspected to have

been committed by any person under this Ordinance, it appears

to the Director that such person is preparing or about to leave

Hong Kong".

6. It appears that nobody had any reason to suppose that

Godber was about to leave Hong Kong. Had they so suspected,

an application would certainly have been made under Section 18

of the Ordinance to prevent him from leaving.

7. A further difficulty lies in the fact that an offence

under Section 10 of the Ordinance is not one for which the

Fugitive Offenders Act can be used since it is thought that the get can be used only y

8. The Police are actively investigating the possibility of

charging Godber with some other offence for which the Fugitive

Offenders Act could be used, but so far no decision has been

taken as to this.
