Governor notifies the Secretary of State of his
decision to reprieve or to allor law to take its course.
In the event of the latter, the Secretary of State will
then take one of two courses, within five weeks of the
date from which notification is received (or within
four weeks if further consultation with the Governor
on the case is required).
Course (1): Notify the Governor of HMG's support for
an execution.
Course (2): Decide to abolish the death penalty in
Hong Kong, instructing the Governor to explain the
Secretary of State's reasons for this to Executive
Council and to seek that Council's concurrence. The
death penalty would then be abolished after allowing
three weeks for discussion in Txeautive Concil.
