seminar on Hong Kong arranged by the Hong Kong Trade Development

Council. From London he is going on to Germany for the same

purpose.

He will return to Hong Kong on 10 June.

The Governor has provided a brief on the points which he

expects will be raised. Sir Y K Kan's main concerns are the

death penalty, the implications for the constitutional relation-

ship between Hong Kong and the UK, and the question of the

Chinese Representative. The Secretary of State is not due to

discuss the Representative with Mr Chi Feng Fei until Thursday.

It will not therefore be possible to cover this question in

detail with Sir Y K Kan. We can, however, reassure him that

the recent discussions on the death penalty do not imply any

change in our acceptance of the importance of Hong Kong's

general interests.

On the death penalty itself, Sir Y K Kan will be looking

for reassurance. He was angry about the Tsoi case, and confirmed

to me in Hong Kong that if it had not been for the persuasion

of the Governor he might have resigned. The Governor, however,

dissuaded him with an able exposition of the real position.

I have submitted separately (my submission of 5 June) on

the use of these talks with Sir Y K Kan to help us make up our
