(b) Regulation 7 sets out the procedure to be followed upon

the occasion of the infliction of the punishment of caning. This follows rule 66 of the Prison Rules (Chapter 234);

(c) Regulation 5 adopts the rather fuller exposition of

disciplinary offences contained in the Prison Rules in place of the more limited list of offences set out in regulation 19 of the present regulations;

(d) Regulation 6(d) provides for appeals to the Commissioner

of Prisons against disciplinary awards made by the officer-in-charge of a training centre. This provision is similar to regulation 16(2), (3) and (4) of the Detention Centres Regulations;

(e) Regulation 6(a) and (b)(i) and regulation 8 lay responsibility

for dealing with all disciplinary reports on the officer-in- charge of the training centre, At present the responsibility rests with the Superintendent who is able to visit each centre now only once a week (and this will become less frequent as new centres open). This involves undesirable

(f) Regulation 4 varies the provisions for earnings by

detainees to allow for cash grants on release is to reduce some of the abuses which the present system of payments and 'canteen money' introduce. issues will in future be free.

Taken together these proposals add up to a new and tougher approach to training centre detention. The primary objective of these centres is not however reduced in importance the tighter discipline needed will in no way prejudice training programmes.

Honourable Members will be asked to advise:

(a) whether the Training Centres (Amendment) Bill 1973, at

Annex A, should be introduced into the Legislative Council; and

(b) whether the Training Centres (Amendment) Regulations 1973,

at Annex B, should be approved in principle, to be submitted to Honourable Members to be made after the bill has passed into law.
