WORKING PARTY ON COMPENSATION FOR

VICTIMS OF CRIMES OF VIOLENCE

FURTHER REPORT

To His Excellency The Governor

Sir,

On the 6th of October 1972 we submitted our Report to you and on the 31st October you ordered that a scheme for compensating victims of crimes of violence be approved in principle but asked the Working Party to submit a revised report to you, taking into account the following views of Council :-

the rates of compensation payable to victims of crimes of dal

violence should be based on those payable to the victims of natural disasters from the Community Relief Trust Fund;

the rates of compensation payable to persons killed or injured when assisting the police or trying to prevent the commission of a crime should be much higher than the recommended 50% increase over the scale payable to persons in the category in sub-paragraph (a);

the rates of compensation payable to persons killed or injured by a law-enforcement officer should be the same as the rates payable to victims of crimes of violence referred to in (a) above, the victim being left to his common law remedy if he wished to claim further damages;

one board should be sufficient to administer all aspects of the scheme.

The Working Party re-convened to discuss these matters and we now present our further report.

We first considered whether the rates of compensation payable to victims of crime of violence should be based on the Community Relief Trust Fund scale or some other scale. We firmly believe that for the reasons given in paragraph 15 of our Report it would not be appropriate to adopt a different scale. We consider that there should be no distinction between the amount of compensation payable to a person injured as a result
