The recommendations of the Working Party on the

four points are summarised as follows:

(a)

(b)

(c)

Comments of Honourable Members

the rates of compensation payable to victims of crimes of violence should be based on those payable to the victims of natural disasters from the Community Relief Trust Fund;

the rates of compensation payable to persons killed or injured when assisting the police or trying to prevent the commission of a crime should be much higher than the recommend - ed 50% increase over the scale payable to persons in the category in sub- paragraph (a);

the rates of compensation, payable to persons killed or injured by a law- enforcement officer, should be the same as the rates payable to victims of crimes of violence referred to in (a) above, the victim being left to his common-law remedy if he wished to claim further damages.

Recommendations of the

Working Party

The Working Party confirms its previous recommendation (paragraph 3 of Annex B) that the rates of compensation should be based on those payable to the victims of natural disasters from the Community Relief Trust Fund.

The Working Party now recommends:

(a) (paragraph 4 of Annex B)

that the Board should have discretion to pay up to twice the amount of the Community Relief Trust Fund scale; and

(b) that the provisions of

section 95 of the Interpreta- tion and General Clauses Ordinance (Chapter 1) should be retained to provide a means for making an exceptional award in special circumstances.

The Working Party maintains (paragraph 5 of Annex B) its previous recommendation that compensation should be based on common law damages.
