EXECUTIVE COUNCIL DECISION OF 20.2.73
The Council considered memorandum XCC(73)14.
The Council ADVISED and the Governor ORDERED:
(a) that the further recommendations of the
Working Party, as summarised in paragraph 4 of the memorandum, be accepted;
(b) that the terms of reference should make it
clear that the Board will be empowered to award to a person killed or injured by a law enforcement officer either the amount of compensation he would have received if killed or injured by a criminal or the amount he would have been awarded as damages at common law if negligence by the law enforcement officer had been established, whichever is the greater;
(c) that, subject to the provision of funds by
the Finance Committee of the Legislative Council, detailed planning of the scheme should proceed; and
(d) that the scheme be brought into operation on
1st June 1973.
