EXECUTIVE COUNCIL DECISION OF 12.6.73

The Council considered memorandum XCC(73)50.

The Council ADVISED and the Governor ORDERED:

(a) that there is no need to change the policy

of requiring the consent of the Governor in Council (or the Governor, if this power is transferred in future as a result of proposals now under separate examination) for affiliations of Hong Kong unions to organisations established outside the Colony;

(b) that the power to revoke authorisation be considered

where experience warrants it;

(c) that bodies purporting to be Hong Kong branches

of overseas trade unions in future be obliged to be constituted and registered only as Hong Kong trade unions;

(d) that applications to affiliate to reputable

international organisations of workers or

employers should as a rule receive favourable consideration;

(e) that applications to affiliate to national trade unions overseas should not as a rule receive favourable consideration unless:

(i)

there would be no element of control by the outside body such as to place the Hong Kong union in a subordinate position to it; and

(ii) all members of the Hong Kong union and their

employer(s) are based in the same overseas country as the overseas union to which the Hong Kong union wishes to be affiliated;

(f) that it would not be desirable to apply (c), (d)

and (e) above retrospectively to the five existing affiliations referred to at paragraphs 12 and 13 of the memorandum (items 2, 5, 6, 11 and 15 of Annex A to the memorandum) even though two of them do not comply with (c) and (e)(i) and three of them do not comply with (e)(ii).
