THE JUDICIARY
9. Much the same problems would apply to the
appointment of the judiciary, under the proposals.
Given the fundamental differences between the British
and Spanish legal systems it would, in addition, be
impractical, if not unacceptable, to insert Spanish
features into the Gibraltarian judicial system.
FINANCE
10. There should be some assurances against a
deterioration in Gibraltarian standards of living.
Britain currently provides £2 million per annum in
capital aid to Gibraltar and is committed to doing so
until 1976. The possibility of Spanish aid is
mentioned in the proposals, but no details are given.
LANGUAGE
11.
Although Gibraltarians speak Spanish more
generally than English, the language issue is a
symbolic and emotional one. To have Spanish as the
sole official language would not be acceptable.
English should at least have equal official status.
RIGHTS AND FREEDOMS OF THE INDIVIDUAL
12. These proposals would need to be spelled out in some detail and foolproof guarantees provided to
ensure that in no circumstances would Gibraltar law
be overriden (see comments on "The Legal Position").
