1. Now that Buckingham Palace have confirmed that we may
submit a new candidate for appointment as Chief Justice
(Sir Martin Charteris' letter of 21 February) and the
Secretary of State has agreed in principle to the appoint-
ments proposed in my submission of 15 February, the way is
clear to ask the Governor to sound out Mr Roberts and
Mr Justice Briggs.

I submit a draft telegram which you have already seen
and discussed.
3. The only outstanding point is whether the assurance
on the question of Mr Roberts' eligibility for appointment
as Chief Justice next time round is enough to satisfy the
Governor's proviso in his telegram No 179. You suggested
a second telegram on this point for the Governor's personal
information. I submit a draft which has been agreed with
Mr Fifoot and Mr Rushford.
