Pollution

A sub-committee of the Port Executive Committee has been formed to examine all aspects of oil pollution, including legisla- tive requirements. In the interim, the Director of Marine considers that certain positive measures should be taken to combat pollution of the waters of Hong Kong. These measures include raising the maxi- mum penalty for polluting such waters, whether the source of the pollution is from land or from ships, to $20,000. Some of the provi- sions of the United Kingdom Prevention of Oil Pollution Act 1971 are adopted for this purpose.

Clause 3 amends section 71 of the principal Ordinance by deleting reference to pollution. Clause 4 adds four new sections (sections 71A, 71B, 71C and 71D) to the principal Ordinance. The new section 71A, which is based mainly on section 2 of the Prevention of Oil Pollution Act 1971, relates to offences connected with the discharge of oil into Hong Kong waters. The new section 71B, which is based on section 11 of the above Act, imposes a duty to report the discharge of oil into such waters. The new section 71C provides for the interpretation of sections 71A and 71B. The new section 71D deals with the pollution of the waters of Hong Kong by means other than the discharge of oil.

Clause 5 redefines "launch" in section 96(i) of the principal Ordinance to include tugs and towing vessels so that these vessels may be dealt with under regulations made under Part XIII of the Ordinance. Under clause 6, section 104(1) is amended to subject oil barges and oil tankers to the controls imposed in Part XIV of the principal Ordinance on small craft.

been endorsed by the Port Committee.
