The essence of this is that if a Convention right is alleged to have been violated, will the domestic law of Hong Kong be capable of rectifying that violation? It does not matter whether the right is described in the same terms as in the Convention, or whether it is described in comparable terms. "In the ordinary course of events" must be emphasised, because we have accepted in the past that it may be necessary from time to time to derogate from the rights granted under the Convention. We have so derogated in relation to, for example, Singapore, Cyprus, Nyasaland, Northern Rhodesia, Zanzibar, Kenya, Aden as well as, of course, in Northern Ireland.
