A United Kingdom belonger who has been ordinarily resident Hong Kong for less than 3 years and is regarded by the Governor as an undesirable immigrant may be removed from the Colony by order of the Governor:

(a)

on the grounds of security or for political reasons affecting the relations of Her Majesty's Government in the United Kingdom with another country, or

(b) otherwise only after consideration by the Governor of the report of a Deportation Tribunal (Section 19(3)).

A United Kingdom belonger may be deported by the Governor in Council at any time if -

(a) he has been found guilty in Hong Kong of an offence punishable with imprisonment for not less than 2 years, or

(b) the Governor in Council deems it to be conducive to the public good

provided that

(i) a court has recommended deportation; or

(ii) the Governor in Council has taken into consideration the report of a Deportation Tribunal on the case; or

(iii) the Governor certifies that the case concerns the

security of Hong Kong or the relations of Her Majesty's Government in the United Kingdom with another country (Sections 20(2) and (3)).

Others

So far as entry, removal and deportation are concerned, the Ordinance makes no distinction between citizens of the United Kingdom and Colonies, British subjects and aliens: all are treated alike.

All may be refused permission to land and may be removed by an immigration officer under section 18. All are subject to removal by the Governor under section 19. And all are subject to deportation by an order of the Governor in Council:

(a)

if they have been found guilty in Hong Kong of an offence punishable with imprisonment for not less than 2 years; or

(b) the Governor in Council deems it to be conducive to the

public good (Section 20(1)).

Their deportation may be ordered without any court recommendation and without any reference to a Deportation Tribunal; nor does it require any certificate by the Governor that the case concerns the security of Hong Kong or the relations of Her Majesty's Government in the United Kingdom with another country.
