HONG KONG IMMIGRATION ORDINANCE 1971

1. This Hong Kong Immigration Ordinance was enacted by the

Governor, with the advice and consent of the Legislative

Council, on 14 October. Ministerial approval for its enactment

was given after the Governor had agreed to the introduction

of certain amendments during the Bill's passage through the

Legislature.

2. However, the Ordinance does not give full effect to

Ministers' wishes (as conveyed to the Governor in FCO telegram

No 628 and as agreed by the Governor in his telegram No 648)

in that it does not provide for reference to a deportation

tribunal in cases involving the deportation of any citizen of

the United Kingdom and Colonies. This was pointed out to the

removed w

Governor and it is clear from his reply that there has been

some misunderstanding in Hong Kong of Ministers' views

to last minute telegraphic exchanges dealing with other

amendments.

3. Under our own recently enacted immigration legislation

any citizen of the United Kingdom and Colonies (other than a United Kingdom patrial) who is in this country and who is to be removed or deported on the grounds that his presence here

is not conducive to the public good has a right of appeal.

But there is no logical reason why the attitude of Hong Kong

towards the removal or deportation of citizens of the UK

and Colonies (other than United Kingdom patrials) should
