IMMIGRATION REGULATIONS 1972

The Immigration Ordinance 1971 was enacted by

the Legislative Council on 13th October 1971. However, subsidiary legislation has had to be drafted and other administrative preparations made before it could be brought into operation. The draft Immigration Regulations 1972 are attached at Annex A for consideration by Honour- able Members.

The most significant provisions of the Regulations

(a) Regulation 2

Section 11(2) of the Ordinance empowers an immigration officer to impose a limit of stay and other conditions of stay on any person who has been given permission to land in Hong Kong. This regulation sets out the general conditions of stay to be imposed on any person who is given permission to land in Hong Kong as a visitor, as a person in transit, as a student, as a person taking up employment, or as a con- tract seaman. These conditions are similar to those that are at present in force.

(b) Regulation 3

This provision empowers the Director of Immigration to issue travel documents on application and on payment of the appropriate prescribed fees. The form of such travel documents will be determined by the Director.

(c) Regulations 5, 6 and 7

These regulations set out the particulars of the crew of a ship, passengers on board a ship and passengers on an aircraft, respectively, which are to be furnished to the Director of Immigration under section 6 of the Ordinance.

(d) Regulation 9

Section 22 of the Ordinance provides for the establishment of a Deportation Tribunal, which will report to the Governor on removal order proposed to be made against a United Kingdom belonger and a deportation order proposed to be made against a United Kingdom belonger or a Chinese resident, except where the Governor
