9. I turn now to the other recommendation.

I have no hesitation

-

in saying that Mr. Cons is a stronger candidate than Mr. Morley-

John. Mr. Cons is only 44 so he could afford to wait indeed he

is somewhat young for the appointment. Mr. Morley-John is some

three years older, but he is a very pedestrian candidate, and I

feel sure that Mr. Cons would be a greater asset on the Supreme

Court Bench than Mr. Morley-John would be likely to be. In the

circumstances I therefore should not think it right to dissent from

the Governor's and the Chief Justice's recommendation that he is

a fit and proper candidate for the appointment and that an offer

should be made to him.

10. I am sending copies of this minute to Sir Vincent Evans,

Sir Leslie Monson and Mr. Fifoot. I have not troubled Sir Vincent

with the papers at this stage but if he wishes to see them he will

no doubt let you know.

11. You will no doubt consider how the despatch should be entered and

or make sure that the ODA is brought in so that the proper drill

may be followed.
