consider Mr Justice Trainor's claims.
RECOMMENDATION
9.
(a)
That, before a formal reply is sent to the two petitions,
a letter should be sent to the Governor which should:-
enclose a copy of the letter from Mr Henry Litton QC
and point out the further difficulties that are likely
to arise if Mr Jackson-Lipkin is appointed to the Bench;
and
(b) mention the candidature of Mr Justice Trainor for one
of the posts of Puisne Judge and attach a copy of his
curriculum vitae.
The Governor should be asked for any comments he might have
in the light of these factors. A draft letter is attached.
10. This submission has been agreed both with the departmental
Legal Advisers concerned and with Gibraltar and General
Department.
