Dormant Commission

In 1951 a Dormant Commission was issued to the Commander British Forces, Hong Kong, in order to provide for his appointment in an emergency as Governor and Commander in Chief of the Colony. A copy of the Commission is enclosed. The situation envisaged at the time was one of a relatively protracted defence of the Colony during which there would be a progressive evacuation. At some stage, by mutual agreement and if possible with the prior approval of the Secretary of State for the Colonies the Commander British Forces would assume overall command by bringing the Dormant Commission into operation and the Governor would leave Hong Kong.

A protracted defence of Hong Kong is no longer practicable, and since 1962 each successive Governor has taken the view that in these circumstances it would be his duty to remain at his post in the Colony. For this reason, and on the advice of both the former Governor, Sir David Trench, and the new Governor, Sir Murray MacLehose, the Foreign and Commonwealth Secretary has come to the conclusion that the Dormant Commission no longer serves a useful purpose and with the agreement of the Secretary of State for Defence he recommends that it should be terminated.

I should be grateful if The Queen's approval of the proposal to terminate this Commission could be sought.
