HONG KONG IMMIGRATION ORDINANCE 1971
1.
The following is a layman's summary of the provisions of the above Ordinance in relation to the entry into and removal or deportation from Hong Kong of the various categories of persons for whom the Ordinance provides.
Categories of Persons
2. The following categories of persons, in descending order of privilege, are provided for in the Ordinance:-
Hong Kong belongers
Resident United Kingdom belongers
Chinese residents

United Kingdom belongers
Hong Kong Belongers

These are defined (section 2(1)) as:
(a) persons who are British subjects by birth or naturalisation in Hong Kong, or registration in Hong Kong under section 7(2) of the British Nationality Act, 1948; and
(b) persons who are or have been married to, or who are the children of persons in (a).
4. Persons in this category are wholly exempt from the provisions of the Ordinance.
Resident United Kingdom Belongers

These are defined (section 2(1)) as persons who are United Kingdom belongers and who have at any time been continuously resident in Hong Kong for 7 years or more.
6. A resident United Kingdom belonger has the right to land in Hong Kong at any time and without any conditions attached to his stay in the Colony, unless there is a deportation order in force against him at the time (section 8(1)(b)).

He can only be removed from Hong Kong by a deportation order made by the Governor in Council. Such an order may only be made if the Governor in Council deems deportation to be conducive to the public good on the ground that the departure of such person from Hong Kong is necessary in the interest of the security of Hong Kong or for political reasons affecting the relations of Her Majesty's Government in the United Kingdom with another country (section 20(4)).
Chinese Residents
These are defined (section 2(1)) as persons other than Hong Kong belongers, who are wholly or partly of Chinese race and have
