Clause 19. This Clause exempts from deportation and from

any conditions of stay any immigrant who is a citizen of

the United Kingdom and Colonies and who has been ordinarily

resident in Hong Kong for a continuous period of not less

than 10 years. The Clause is designed by the Hong Kong

authorities to reflect those provisions of the United

Kingdom Bill which provide that citizens of the United

Kingdom and Colonies who are not United Kingdom patrials

could become United Kingdom patrials after 4 years

conditional stay followed by 5 years further residence in

this country. In fact Her Majesty's Government have now

decided to amend the United Kingdom Immigration Bill to

provide that such persons become patrials and thus cease

to be subject to immigration control after 5 years

residence (including any period of conditional stay) in the

United Kingdom. It is considered that this fact should be

brought to the notice of the Governor and that he should

be asked to arrange for this Clause to be amended to provide

exemption from deportation and conditions of stay for

citizens of the United Kingdom and Colonies who have been

ordinarily resident in Hong Kong for 5 years or more.

Clause 49. This Clause provides for the lodging of

objections to the Governor or to the Governor-in-Council

(dependent on the circumstances of the case) against any

decision, act or omission of a public officer acting under

the Ordinance. The decision of the Governor or Governor-

in-Council is final and there is no provision for any further

appeal. (However, this would not exclude the possibility

of political representations being made by an aggrieved

person to the Secretary of State; nor would it affect the
