Amend the Probation of Offenders Ordinance.
ANNEX TO XCR(71)71
Enacted by the Governor of Hong Kong, with the advice and
consent of the Legislative Council thereof.
Short title.
1. This Ordinance may be cited as the Probation of Offenders
(Amendment) Ordinance 1971.
Amendment of section 3. (Cap. 298.)
2. Section 3 of the principal Ordinance is amended in subsection
(1) by deleting "and where such court does proceed to conviction
instead of sentencing him, ".
Addition of
new section 3A.
3. The principal Ordinance is amended by adding, after section
3, the following new section
"Restriction on punishment of probationer.
(Cap. 222.)
34. An offender in whose case a probation
order is made may in addition be sentenced under
the Corporal Punishment Ordinance to be caned, but
save as aforesaid an offender in whose case a
probation order is made shall not be sentenced.".
Explanatory Memorandum.
The purpose of this Bill is to enable a court to combine
a probation order with a sentence of caning.
