Thank you for your letter of 14th January 1971 on the question of payment for services provided by H.M. Forces in connection with the 1967 disturbances.

(a)
As regards the two points in your second paragraph
to the extent that the "Highland Bonnet" works were maintenance, they would now be a charge to the Hong Kong Government if they involved observation posts, Police posts (even though occupied by the Military) and associated accom- modation, and if the buildings had been handed over to the Public Works Department for maintenance. The latest policy statement on maintenance of border works refers to the Military being "responsible for all defence works and for all accommodation and tracks they have built and not formally handed over to the P.W.D. for maintenance (in other words, my statement under (4) in my letter of 18th December 1970 that "the Hong Kong Government was responsible for the maintenance of all buildings required for operational reasons on the border" has since been modified);
(b) to the extent that "Highland Bonnet" involved
new works, they would have been a charge to the Hong Kong Government if the Government so agreed.
