1. Our departments have been in correspondence on the question of financial responsibility for the cost of the "Snake" fence and other border works for 4 years, the latest exchange of letters being your letter of 1 March and mine of 31 March 1971.

2.

We appear to have reached a complete impasse on this matter. Your letter of 1 March expressed the hope that we would agree to bear the cost of the minor works services against Defence Votes without mentioning the "Snake" fence. However, I am afraid that we see no justification for Defence Votes bearing the cost of either of these items. If you consider it inappropriate that the Hong Kong Government should be pressed to meet their cost we feel that your Department should reimburse MOD.

3. I suggest that the best way to settle this long outstanding question is to ask the Treasury to adjudicate on the matter. With your agreement, therefore, I propose to write to them accordingly.
