1. In his saving despatch to the Governor, No. 13 of 9

January 1970, the Secretary of State agreed there was no

objection to the extended use of the powers to grant permission

for adult women to work at night by means of selective

exemptions under Section 7(4) of the Factories and Industrial

Undertakings Ordinance (Cap 59).

2. As a result, the Commissioner of Labour was authorised

to consider applications from managements of selected

industrial undertakings to employ women at night for a trial

period beginning on 1 March 1970 and ending on 30 June 1971.

Managements were required to observe certain general conditions

applicable to all industrial undertakings and any special

conditions required in respect of individual factories; and

it was made clear at the time that (as stated in paragraph 3

of the Governor's saving despatch No. 275 of 4 March 1970) "the

scheme would be reviewed in about 12 months' time to determine

whether or not to extend it beyond June 1971 so that adequate

warning could be given if it was decided to terminate the

experiment".

In his saving despatch No. 361 of 11 May 1971 the Governor

reported that the Commissioner of Labour had completed a

review of the scheme. He said that the Commissioner was

satisfied that the scheme had been of some help in meeting

a shortage of industrial labour, that a shortage was likely to

persist and that the scheme would help to meet an anticipated

shortage in the future. The Commissioner accordingly proposed
