(2) For the purpose of calculating the period for which a
person has been ordinarily resident in Hong Kong, no account
shall be taken of any continuous period of six months or more
during which he has been detained under a sentence or order
passed or made by any court on a conviction of an offence.
Examination of persons arriving and departing.
PART II.
Control of immigration.
5. (1) For the purposes of this Ordinance, an immigra-
tion officer may examine any person who arrives in or intends
to depart from Hong Kong.
(2) Save as otherwise provided by this Ordinance, a person
shall not be required to submit to examination under this section
after the expiry of twenty-eight days from the date on which he
lands in Hong Kong unless, on being examined within that period,
he is required by an immigration officer to submit to further
examination.
Powers of Director and requirements in relation to examina- tions under section 5.
6. (1) The Director may require the master of a ship or
commander of an aircraft to produce in such manner as the Direc-
tor may specify for examination under section 5 -
(a) the passengers arriving or departing in that ship or
aircraft; and
(b) the members of the crew of that ship or aircraft.
(2) A requirement under subsection (1)
(a)
shall be deemed to be made to the master of the ship
or commander of the aircraft if it is made to the
owner of the ship or aircraft or his agent;
