(2) In the event of a contravention without reasonable

excuse of subsection (3) of section 10

(a) the master of the ship or commander of the

aircraft, as the case may be; and

(b) the owner of the ship or aircraft and his agent,

shall be guilty of an offence.

40. Any person who is guilty of an offence under this

Ordinance for which no penalty is provided shall be liable

on conviction to a fine of five thousand dollars.

Continuance of certain offences.

41.

Where a person is convicted of an offence under

subsection (1) of section 39 consisting of a contravention of

subsection (1)(a) of section 10 or subsection (1) of section 11

and the contravention continues after the conviction, then,

unless he has a reasonable excuse for the continuance of the

contravention, he shall be guilty a further offence under

subsection (1) of section 39 and shall be liable on

to be punished accordingly.

Limitation of time for prosecution of summary offences.

42. A complaint may be nade or an information laid

in respect of an offence under this Ordinance punishable

only on surmary conviction within twelve months from the time

when the watter of such complaint or information respectively

arose.

Forfeiture of vehicles and ships.

43.

(1) Any vehicle and any ship not exceeding five

hundred gross tons which has been used in the commission of
