Mr. Wilford has asked for the draft of an interim reply to the letter at (2) from the Attorney-General, Hong Kong. A draft reply is attached.
2. As Mr. Roberts states in paragraph 2 of his letter, he left an earlier version of the Bill with Mr. Rushford in July/August. Please see Mr.Rushford's
comments at (1) on this, file.
3. When I saw Mr. Roberts in August, I passed on to him the gist of Mr. Rushford's comments, but in so doing I suggested that the Bill should be forwarded formally to us under cover of a Saving Despatch with a legal report and a comparative table attached. However, although the present draft has not been sent to us under formal cover, I do not think we can quibble at this; Mr. Roberts has provided with the Bill an explanatory memorandum and a comparative table of sources. Moreover, he states that the Governor also has a copy of the Bill and may wish to discuss it with us in general terms during his present leave.
4. The provisions of the Bill which, at first sight, are most likely to raise political difficulties, are those which provide increased powers for getting rid of British subjects and those which incorporate in the Bill the provisions of the Emergency (Deportation and Detention) Regulations. This is yet another example of the Hong Kong Government's desire to embody emergency legislation in the permanent laws of the Colony. You may recall that the Governor referred to these particular emergency regulations in his long letter about the increase in crime in Hong Kong.

After a reply 2 Mr. Roberts has issued the file will be passed to the Legal Advisers for their comments; it would be as well if the Bill were also seen by Migration and Visa Department and Nationality and Treaty Department. They saw the original version. of the draft but did not comment at that stage.
