Many thanks for your helpful letter of 5 May about the Judiciary.
We are grateful for this full account of the considerations you had in mind when you decided to shelve the preposals for creating a separate post of Judge of Appeal and a separate Court of Appeal. In particular, we agree with the view taken by Rigby to which you refer in the third paragraph of your letter.
As regards filling the vacancy of Senior Pui:ne Judg while still thinking that Blair-Kerr is the better candidate, we do not feel it necessary to press our objections to Scholes, since Blair Kerr will have an opportunity of taking over from Scholes next year. As promised in zy telegram No. 355, a Saving Despatch in reply to your Despatch No. CR.171749/53 II of 5 February is being sent to you in the bag leaving here on Saturday, 30 May.
