Hong Kong District Judges
Sir J. McPetrie has recently been looking into the question
of warning District Judges in Hong Kong that, on retirement or
resignation, they would not be permitted to practice at the local
His minute to me of 21 April sets out the background. The Lord Chancellor's Office agree that undertakings should be
required from those in future appointed to the office of District
Judge about not practising on retirement.

3. It has now been accepted that Mr. Justice Scholes should be promoted to the post of Senior Puisne Judge (a Saving Despatch informing the Governor of this is being prepared). I agree,
therefore, with Sir J. McPetrie that we should telegraph Hong Kong in the terms of the draft which he has prepared. I do not think it necessary to consult Ministers about this, particularly now that
a General Election has been called.

Please refer to our exchange of minutes of 21 and 23 April at folios 15 and
16 and the letter from Mr. Boggis-Rolfe in the Lord Chancellor's Office at
folio 20.

If it is decided that we should support the Chief Justice's suggestion, and
I think we should, we must now communicate with the Governor. In view of the
impending appointments to the District Court of Mr. Leonard and Mr. O'Connor, we
should perhaps do this by telegram and I attach a draft for your consideration.
It is in personal form (as from Sir Leslie Monson ?) but could easily be adapted.
I think it likely that the Governor will agree to the proposal (see the
penultimate paragraph of the Attorney-General's letter of 13 February at folio 1)
but we cannot take his agreement for granted (see paragraph 5 of my minute to you of 21 April). It is, I think, for you to decide whether Ministers should
be consulted and whether a follow-up despatch or savingram extending the scope
of the existing circular savingrams would be advisable, as suggested in
paragraph 3 of the draft.
Such a despatch or savingram can be restricted to
Hong Kong for there are no other Judges of intermediate jurisdiction in the
dependent territories whom we need worry about in this context - see paragraph 6
of my letter of 24 April at folio 18 and items 3, 4 and 5 of the list at
folio 17.
