Objection has been taken to this clause in that it is an offence for a person to fail to give information, if so required, about property belonging to or liabilities incurred by his spouse, parents or children, information which he might very well not have at all. The clause has therefore been deleted to remove this requirement. However, other paragraphs of the same clause will enable the information to be obtained direct from the spouse, parents or children of any person under investigation.
The intention of subclause (4) is to protect a legal adviser against disclosing privileged information which comes to him from a client, Previously, the wording of this subclause only protected from dis- closure information which came to the legal adviser "for the purpose of proceedings begun or in contem- plation before a court". It is considered that the clause ought also to protect information coming to a legal adviser to enable him to give legal advice to a client and the subclause has been amended accord- ingly.
has been amended to refer to a Crown servant, instead of to a public servant, for the same reason as the amendments made to clause 13.
