The clause will be reframed in such a way as to
remove the penal liability of a suspect or accused person
under clause 14. Instead the clause should allow for him
to be required to comply, for his answer to be admissible
in evidence, and for his failure to answer to be the subject
of comment at his trial.
Clause 15.
We will amend this so as to try to preserve the
confidential nature of instructions to a legal adviser from
his client.
Clause 18.
We will, at a suitable opportunity, give magistrates
power, in all cases, to require surrender of a passport as a
condition of bail. Meanwhile we will remove specific reference
to this, from the Bill. To meet your objection about damaging
publicity, the clause will provide for the hearing of applications
under it to be conducted by a magistrate in chambers.
