Amend the Magistrates Ordinance and to amend consequentially the
Defamation Ordinance.
Enacted by the Governor of Hong Kong, with the advice and
consent of the Legislative Council thereof.
Short title.
1. This Ordinance may be cited as the Magistrates (Amendment)
(No. 3) Ordinance 1970.
Addition of new section 19A. (Cap. 227.)
The principal Ordinance is amended by adding, after section
19, the following new section
"Plea by a corporation before a magistrate. 1967, c.80, s.29.
19A. (1) On the hearing by a magistrate of any
complaint or information against a corporation, a
representative may on behalf of the corporation enter
a plea of guilty or not guilty.

(2) Where a representative enters a plea of not
guilty under subsection (1), he may exercise the rights
under subsection (1) of section 16 as if he were an
individual defendant against whom the complaint is made
or the information laid.

(3) Subsection (4) of section 49 of the Criminal
Procedure Ordinance shall apply mutatis mutandis to a
representative for the purposes of subsection (1) as it
applies to a representative for the purposes of that
section.
